GENERAL TERMS & CONDITIONS
Engine Dynamics (ED) and its suppliers provide their services to you subject to the following conditions. If you visit or shop at ED, you accept these conditions. Please read them carefully. In addition, when you use any current or future ED service or visit or purchase from any business affiliated with ED, whether or not included in the ED Web site, you also will be subject to the guidelines and conditions applicable to such service or business.
When you visit ED or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing and are not to be published elsewhere.
All content included on this site, is the property of ED and its affiliates. The compilation of all content on this site is the exclusive property of ED unless permission is otherwise granted.
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or web browsing device. You agree to accept responsibility for all activities that occur under your account or password. ED reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at their sole discretion.
In most instances Standard or OEM replacement items hold a minimum 12 month manufacturer's warranty.
Very few Race, Performance or Modified items are provided with Warranties and most are sold without any express warranty. If you need clarification before buying please contact us. In regard to products supplied and fitted at ED, a 12 month or 12,000 mile (whichever soonest) parts and labour warranty is given on any Standard or OEM replacement items. In respect of performance products and packages we offer selective warranties due to varying levels a different parts used. This can be discussed with us before any work is carried out.
In the unlikely event that you do have any issues with any products supplied, please contact us and we will work with you and if needed the manufacturer to resolve as quickly as possible. ED are unable to supply any replacement item until we inspect or the manufacturer approves a credit and or provides a replacement.
Please note a returned faulty item may involve a time scale to return to the manufacturer for inspection. If for any reason you need a replacement item urgently, your sole remedy is to purchase another item of which we will only refund the payment once a replacement has been approved. ED will not be held liable for any extra costs incurred i.e labour and vehicle downtime under any circumstances, as a result of goods supplied.
Deliveries are carried out using a professional courier company or postal service with tracking. Insurance options are available to the customer at the website checkout and we would strongly recommend they are selected. ED makes every attempt to pack consignments carefully and correctly, but accepts no responsibility for damages to goods in transit or for total loss if an insurance option is not selected during the checkout. UK Telephone order customers will be offered insurance options when placing the order.
When receiving the parcel, it is the customer's responsibility to check for damage before signing for any consignment. Please check all packaging and if you have concerns that a package may be tampered with or damaged, then please sign the couriers form with "Damaged" or "Unchecked". If the courier will not allow you to sign such words or you have doubts, then simply refuse the package. By doing this we can attempt to claim some compensation from the courier if the package is insured.
Missing or damaged goods need to be reported to ED within 72hrs from delivery, after this time we cannot be responsible for any replacement items.
Every effort is made to ensure that goods are dispatched as quickly as possible; ED can accept no responsibility for delayed or back order items. Delivery times for all items are given in good faith, but again ED cannot be held responsible for delayed deliveries. In the instance of part order being delayed, ED reserves the right to request supplementary carriage funds to cover costs if the customer requests split deliveries.
Please ensure that there is a person at the delivery address between the hours of 8am to 6pm in order to sign for the consignment. If no one is available the delivery agent will leave a card or notice of attempted delivery. In most cases the agent will attempt to deliver again next working day, if again you are unavailable at this time you must contact the agent to arrange another date or collection from the depot. (Details can be found on the card that is left with you.)
In the instance of failed delivery, ED reserves the right to request supplementary funds in order to cover increased costs. On this note we advise the customer to provide a specific date for delivery, if this cannot be meet, due to back order or a slight delay on awaiting stock, ED will notify the customer by the email address that was provided during the order procedure and request a new delivery date once parts have come back into stock.
ED and its suppliers attempt to be as accurate as possible. However, ED does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by ED itself is not as described, your sole remedy is to return it in unused condition for a refund.
Any item purchased online from Engine dynamics is an offer from us for the product at the price displayed; this offer will not be accepted as an order until such time as the order is shipped. Only at this time will ED accept the price given. However if there are any changes in price, only in regard of higher prices, we will contact the customer using their email address provided to confirm the change and will only finalise the order under the customers consent. Any price reductions will be considered in the customers favour and changed automatically; therefore we will not contact the customer on this matter for consent.
RETURNING GOODS / REFUNDS
In accordance with the consumer contract regulations (CCR) any products purchased by customers within the European Union (EU) are subject to a 14 day cancellation period from date of delivery. During this period the purchaser can arrange to return any unused and unopened stock parts for a full refund including shipping costs. The return shipping cost is the responsibility of the purchaser. For this to apply the purchaser must contact us within 14 days of delivery. Please note that CCRs are NOT applicable to 'Special Purchase' items, these are clearly marked in the items description.
If the sale was for multiple items and only some items are being returned within the 14 day period, then we will not refund the purchasers original shipping cost as some items have been accepted. CCR's apply to any order that is shipped to the customer without prior viewing or consultation in person. CCR's do not apply to online Auction parts, Special Purchase, Collected, or parts fitted in the workshop.
Outside the 14 day period all unused parts sold correctly may be returned by agreement for a refund less a 20% restocking / admin fee if within 28 days from the original dispatch date. No unused parts will be refunded after 28 days of dispatch date. Exchange surcharge items i.e. engines and turbo chargers will only be refunded if the exchange item is serviceable. If the exchanged item is not serviceable, then we will not be able to refund the exchange surcharge. Please contact us to clarify requirements before ordering any exchange items. All exchange items must be returned within 60 days to apply for a full refund of the exchange surcharge.
All refunds will be processed within 14 days once items have been received / inspected and authorised. Refund payment will be made back to the original payment method. By visiting or purchasing at Engine Dynamics (ED), you agree to these terms and conditions without exception.
